Privacy Policy

1. About These Terms

These Creator Terms of Use ("Terms") govern your access to and use of the Socialscale Creator Hub (the "Platform"), operated by FRL Limited, trading as Socialscale ("Socialscale", "we", "us"). By creating an account, you (the "Creator", "you") agree to these Terms in full.


Socialscale operates as an intermediary between Creators and brand clients ("Brands"). When you participate in a campaign through the Platform, you are engaging with a Brand for whom Socialscale manages creator programs. All content rights granted through the Platform are granted to the applicable Brand, not to Socialscale, unless explicitly stated otherwise.


2. Eligibility

To use the Platform, you must:

  • Be at least 18 years old

  • Have the legal right to enter into binding agreements in your jurisdiction

  • Own or control the social media accounts you register with us

  • Not be prohibited from using the Platform under applicable law


3. Your Account

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at hello@socialscale.ai if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.


4. Participating in Campaigns

When you accept a campaign through the Platform, you agree to:

  • Deliver the content described in the campaign brief by the specified deadline

  • Follow the Brand's creative guidelines and incorporate reasonable revision requests

  • Post and keep content live as directed, unless told otherwise in writing

  • Not delete, archive, or materially edit posted content without written approval


Campaign-specific terms (deliverables, fees, deadlines, brand name) are confirmed at the point of campaign acceptance within the Platform. Those details, together with these Terms, form the complete agreement for each campaign.


5. Content Ownership

When you create content for a campaign, all rights to that content transfer fully and permanently to the applicable Brand upon delivery. This includes:

  • The right to use, edit, republish, and license the content anywhere — including paid advertising

  • The right to use your name, handle, likeness, and voice in connection with the content

  • Rights that are worldwide, perpetual, royalty-free, and irrevocable


Work Made for Hire: To the extent permitted by law, content created under a campaign is a "work made for hire." If ownership does not transfer automatically, you assign all rights to the Brand effective immediately upon delivery.


The fee paid per campaign is your complete and final compensation. No additional royalties or residuals will be owed for any use of the content.


6. Your Content Warranties

For every piece of content you create through the Platform, you confirm that:

  • You own it and it does not infringe any third-party copyright, trademark, or other rights

  • It does not include unlicensed third-party music, footage, or images

  • Any people who appear in it have given you permission to include them

  • It is not false, misleading, defamatory, or illegal

  • It complies with all applicable laws and the rules of the platform it is posted on


7. Sponsorship Disclosure

You must clearly disclose any paid partnership when posting. Use the platform's built-in "Paid partnership" tag and include #ad or #sponsored in your caption or video, as required by FTC guidelines and applicable law. Non-compliance may result in campaign disqualification and withheld payment.


8. Payment

Fees for each campaign are communicated through the Platform before you accept the campaign. Payment will be made within the timeline stated in the campaign details, provided you have fully delivered approved content.


Taxes: You are solely responsible for all taxes on your earnings. Socialscale and the Brand will not withhold taxes on your behalf. You will receive a 1099 or equivalent tax document where required by law.


9. Conduct

You agree not to:

  • Make defamatory, disparaging, or harmful public statements about any Brand, Socialscale, or their products

  • Engage in behavior that brings serious public controversy or disrepute to you, a Brand, or Socialscale

  • Use the Platform for any unlawful purpose or in violation of any applicable regulations

  • Attempt to circumvent, hack, or interfere with the Platform or its security


Breach of this section may result in immediate account termination and forfeiture of any outstanding payment.


10. Confidentiality

Non-public information shared with you through the Platform — including campaign strategy, product details, pricing, and business plans — is confidential. You agree to:

  • Not share it with anyone outside the campaign

  • Use it only for completing your campaign deliverables

  • Not disclose the financial terms of any campaign to third parties


This obligation survives termination of your account.


11. Competing Content

Unless agreed otherwise in writing, you may work with other brands. However, for 30 days following a campaign post, you agree not to create or post content for a direct competitor of that Brand without prior written consent from Socialscale.


12. Your Responsibility

You agree to defend, indemnify, and hold harmless Socialscale, the applicable Brand, and their respective officers, employees, and agents from any third-party claims, damages, or legal costs arising from: (a) your breach of these Terms; (b) false or misleading content you created; (c) your negligence or misconduct; or (d) your failure to pay applicable taxes.


13. Termination

You may close your account at any time. We may suspend or terminate your account if you breach these Terms, with or without notice depending on severity. Termination does not affect the Brand's ownership of content already delivered, or any outstanding payment obligations.


14. Changes to These Terms

We may update these Terms from time to time. We will notify you by email or through the Platform. Continued use of the Platform after changes take effect constitutes your acceptance of the updated Terms.


15. General

Governing Law: These Terms are governed by the laws of Hong Kong S.A.R.


Entire Agreement: These Terms, together with campaign-specific confirmations accepted through the Platform, constitute the complete agreement between you and Socialscale.


No Assignment: You may not transfer your rights or obligations under these Terms without our written consent.


Severability: If any part of these Terms is found unenforceable, the rest remains in effect.


Survival: Sections 5 (Content Ownership), 6 (Warranties), 10 (Confidentiality), and 12 (Indemnification) survive account termination.

At Socialscale, we respect your privacy and your right to control your personal data.

If you would like to request deletion of your Socialscale account and associated personal information, please follow the steps below.

How to Request Deletion

Submit a Deletion Request

If you cannot access your account, please email:

Include:

  • Your full name

  • Email address associated with your account

  • Subject line: “Data Deletion Request”

We may request additional information to verify your identity before processing the request.

What Data Will Be Deleted

Upon approval of your request, we will delete or anonymize:

  • Account information

  • Profile information

  • Creator information

  • Campaign participation records

  • Uploaded content and files

  • Platform activity data

  • Connected social account data stored by Socialscale

What Data May Be Retained

We may retain certain information where required for:

  • Legal obligations

  • Tax and accounting requirements

  • Fraud prevention and security purposes

  • Dispute resolution

  • Enforcement of agreements

Any retained information will be kept only as long as required by applicable law.

Processing Time

We aim to process deletion requests within 30 days of verification.

Socialscale may use artificial intelligence and automated systems to analyze content, creators, products, campaign performance, and other platform activities.

Information submitted to the Services may be processed by AI models and technology providers to generate recommendations, insights, content analysis, or other platform features.

Users remain responsible for reviewing AI-generated outputs before relying on or publishing them.

5. Sharing of Information

We do not sell personal information.

We may share information with:

  • Service providers and contractors

  • Payment processors

  • Cloud hosting providers

  • Analytics providers

  • AI technology providers

  • Professional advisors

  • Law enforcement or government authorities when required by law

  • Other users where functionality requires sharing (for example creator profiles, campaign participation, storefronts, or affiliate programs)

Your information may be processed and stored in Hong Kong and other countries where our service providers operate.

By using the Services, you acknowledge that information may be transferred to jurisdictions with different data protection laws than your country of residence.

Where required, we implement reasonable safeguards for such transfers.

7. Data Retention

  • Provide the Services
